Family Petitions
The family-based immigration process typically begins with a petitioner, who is a U.S. citizen or lawful permanent resident, making a request to the U.S. Government to allow a family member to immigrate to the United States.
U-Visa
A U-Visa is a type of non-immigrant visa, reserved for temporary entrants to the United States. It provides four years of lawful status to non-citizens who have been victims of certain crimes in the U.S., have suffered substantial harm as a result of the crime, and who are helpful to law enforcement in the investigation or prosecution of the crime.
T-Visa
A T-Visa is a type of non-immigrant visa, reserved for temporary entrants to the United States. It provides four years of lawful status to non-citizens who have been victims of human trafficking, and are present in the United States as a result of that trafficking.
VAWA Petitions
Under the federal Violence Against Women Act (VAWA), a person may self-petition to become a lawful permanent resident (LPR) if he/she is the victim of battery or extreme cruelty by a US citizen or LPR spouse, parent, or child.
Asylum
Under federal law, asylum is legal protection afforded to a person who can demonstrate a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group.
Citizenship & Naturalization
A certificate of naturalization is given to someone who later becomes a citizen via the naturalization process. The naturalization process requires applications to attend an interview, take a civics test, and in certain cases pass an additional English test. Once approved, the applicant is required to take an oath of allegiance to the United States. The person will then be afforded the full rights and responsibilities of a citizen of the United States.
Removal Defense
If you have been issued a Notice to Appear, or are detained, you may hire an immigration attorney to defend you during your proceedings.

Special Education Law

Individual Education Program (IEP) Advocacy
If your child has an Individual Education Plan “IEP”, hiring an attorney can help facilitate communication between the parents and the school district. Or, if you think your child needs an IEP an attorney can help you communicate your concerns.
Due Process Litigation
At some point parents may need to file a due process hearing request against their child’s school district. Going through due process litigation can be daunting and having an attorney will make sure you get what your child needs through this process.
504 Plan Advocacy

About Victoria Lucero, Esq.
Victoria was born and raised in Northern New Mexico. She had her first international experience in high school, when she was able to travel to Spain and Portugal on a class trip. Since that first international trip, she was enthralled by the idea of global travel. During her undergraduate studies at the University of New Mexico she became an advocate for recently resettled refugees. At that time she started working alongside other immigration attorneys and decided to pursue law school.
Victoria attended Loyola Law School in Los Angeles, California. There she had the opportunity to work for a nonprofit specializing in special education law and the Loyola Immigrant Justice Clinic. Under supervision, Victoria represented clients across California and at the immigration court in El Paso, Texas. She returned to her home state in 2020 where she decided to open The Law Office of Victoria Lucero, LLC.
She believes that every person deserves to live their life with dignity and without fear; every undocumented person should be able to obtain lawful status; and no one is equal until we achieve equality in education.

The intake process starts with just a phone call! When you call into the office you will be asked a series of questions to determine what relief you might qualify for. You will then be scheduled for a consultation with the attorney. You may be asked to bring in basic documents to support the relief you are seeking. At the time of the consultation the attorney will go over a strategy for your case. You can then decide if you would like to retain Victoria as your attorney.
Immigration law is federal law! That means that Victoria can practice in any state in the United States. If you do not live in New Mexico, Victoria may still be able to help. Call the office to start the intake process.
The Law Office of Victoria Lucero, LLC offers IEP Advocacy, Due Process Litigation, and 504 plan advocacy services. However, our office is more than happy to create a hybrid plan that works best to meet your child’s needs.
For special education legal services, Victoria can travel throughout the state of New Mexico.
Please be aware that because of the COVID-19 pandemic most services will be conducted virtually.
The Law Office of Victoria Lucero, LLC believes that COVID-19 safety is of the utmost importance. To protect the clients and the attorney, we offer limited in-person office visits. Most interviews and conversations will be scheduled over ZOOM or telephonically.
If you do need to have an in-person meeting with Victoria, you must wear a mask to enter the office building and keep your mask on throughout your meeting. I ask that you do not bring more than one other person to your in-person meeting.
At your consultation the attorney will review detailed strategies on how our office could handle your legal situation. For immigration clients, the attorney will go over each strategy available for your case. If there are none, the attorney will explain why you are not eligible to obtain status at that time. For special education clients, the attorney will review each of the service options available to your family. At the end of the consultation you will be given a quote and sent a retainer that you can take and review, or sign that day.
